Night Flying Under Part 107: The Anti-Collision Light Rule and What Three Statute Miles Means

Operating a drone under Part 107 at night is only legal when the drone carries anti-collision lighting visible for at least 3 statute miles, and the remote pilot has completed the required training or passed a knowledge test after April 6, 2021. This key rule is easy to state, but the tech requirements behind it get more complicated.

What the rule actually says

The rule's legal standard comes from 14 CFR § 107.29. It says the remote pilot in command (PIC) must have completed an initial knowledge test or training after April 6, 2021, and the small unmanned aircraft must have lighted anti-collision lighting visible for at least 3 statute miles with a flash rate sufficient to avoid a collision. The same anti-collision-light rule also applies during civil twilight, the period just after sunset or before sunrise.

The Federal Register version of the current rule package keeps the same 3-statute-mile standard with a collision-avoidance flash rate. It also says the remote pilot in command may reduce the intensity of, but may not extinguish, anti-collision lighting if it is in the interest of safety to do so. So a strobe purchased only for the look may not meet the rule as the owner expects.

Three statute miles is the real test

The 3-statute-mile standard turns on visibility distance from a theoretical viewer, not just a strobe's overall brightness. The FAA Advisory Circular AC 107-2A states that during civil twilight, the small UAS (Unmanned Aircraft System) must be equipped with anti-collision lighting visible for at least 3 statute miles. The same advisory circular also says the remote PIC may reduce the visible distance of the lighting to less than 3 statute miles during flight if it would be in the interest of safety to do so. So the “3 statute miles” rule is not about a cosmetic setting, but about whether other pilots would actually see the anti-collision lights in flight.

Secondary guidance consistently describes the 3-statute-mile visibility rule as more than just needing a bright strobe or some generic light. One example says the remote PIC bears responsibility for ensuring the lighting system on the specific drone actually meets the 3-statute-mile standard, rather than relying on a cosmetic accessory.

The FAA rule text gives the required flash rate in terms of the light's collision-avoidance function, not a numeric specification, so the system chosen has to actually work, not just look eye-catching.

Night training and civil twilight

Civil twilight operations have a separate set of rules from night operations. 14 CFR § 107.29 (b) also permits civil twilight operations only if the small UAS has lighted anti-collision lighting, and the remote pilot in command completes an initial knowledge test or training under § 107.65 after the rule’s effective date. Airspace checks and equipment inspections are just as important for civil twilight as for night operations.

The might not be clearly communicated to all readers, and they might overlook the civil twilight section.

Safety override

The remote pilot can reduce or extinguish anti-collision lighting when safety requires it, but cannot extinguish the light for other reasons. FAA Advisory Circular AC 107-2A says the remote pilot may reduce the visible distance of the lighting during flight if in the interest of safety. So this rule creates exceptions like, presumably not for product marketing, but to allow safety markings.

The airspace check before launch

A 3-statute-mile strobe does not replace normal airspace checks. The anti-collision-light rule is not a standalone authorization. The remote pilot still needs to request an airspace authorization for night flights in controlled airspace under the Low Altitude Authorization and Notification Capability (LAANC).

Conclusion

Authorized night operation is legal under Part 107 only when the drone carries anti-collision lighting visible for at least 3 statute miles, the remote pilot has night training or has passed a knowledge test after April 6, 2021, and the remote pilot has requested an airspace authorization in controlled airspace.
